WELCOME TO UTAH - AMERICA'S FOREMOST POLICE STATE!


For the past twenty years or so Utah has been ruled by a single political party that has become proud and arrogant, with the disposition and will to crush every thing that opposes it or its dicta and mandates. They have instituted laws and policies that are dangerous, hurtful, and oppressive. They have done this while deluding themselves that they are upright, honest, and righteous men. Their actions show that they believe their judgment and opinions to be better than that of the common man. Some of these men have even thought that they were the law, or that they were above the law until they were caught stealing gas or soliciting prostitutes. Others demonstrate this propensity by simply disregarding the constitution or the will of the people. This has resulted in the Legislative, Executive, and Judicial branches of our government devolving into power hungry narcissistic, elitist, sycophants.

I support the will of the people.

Initiative B was passed overwhelmingly by a 69% MAJORITY of Utah’s voters in the 2000 election. Initiative B was and is the will of the people of Utah. If I am elected to represent the people of my district I will work to restore Initiative B. One of the things this initiative did was turn the proceeds from asset forfeiture over to the school fund. This was the LAW OF THE LAND for three years until the legislature changed it back.

Our Government seems to have forgotten that according to the constitution

“All political power is inherent in the people; and all free governments are founded on their authority for their equal protection and benefit, and they have the right to alter or reform their government as the public welfare may require.”

This spring the Utah Legislature voted to strip Utah citizens of their constitutionally guaranteed rights by gutting Utah’s Initiative B.

They called it  “PROTECTION OF PRIVATE LAWFULLY OBTAINED PROPERTY” 
but this new law is anything but that. Once again the proceeds of asset forfeiture go the police.

This action by the Utah Legislature is a blatant disregard for the will of the people and for the rights of the people. The senators and representatives in the Utah legislature are supposedly there to protect the rights of, and represent the will of the people in their districts and have actually done the opposite.

The legislators who did this are dictating to the people of Utah rather than representing them honestly and because of this they are not fit to be representatives of the people and should dismissed from office.

During the three years that Initiative B was the law of the land prosecutors and police have disregarded the law (Initiative B) and illegally seized property from Utah citizens. They have kept the proceeds rather than turning the money over to the school fund as the law required.

These corrupt police and prosecutors should be removed from office and fired from the police force. Prosecutors who disregard the law should be stripped of their Law Licenses and Police who disregard the law should be stripped of their Post Certifications and their badges and then face charges.

Police and prosecutors who disregard the laws they don’t like are unfit to be employed by the people of Utah or anybody else for that matter. In fact they should be prosecuted. When ‘WE THE PEOPLE’ reinstate Initiative B we should add provisions to the law to do just that. We should make non-compliance with Initiative B a felony.

If it looks like a duck, and it quacks like a duck

It may actually be a duck trying to beef up his departments budget by taking your house, car, or other property. Can it ever be right for any government agency or police department to take without just compensation, ANY CITIZENS property for its own use or profit? Even if the property is legally taken is it right for the police to keep it? Or should the profit incentive be taken out by giving the proceeds to the schools?

The People of Utah must stand up for their rights by removing these miscreants from office.

Bill of Rights U.S. Constitution

Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Amendment V

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

UTAH CONSTITUTION

ARTICLE I

DECLARATION OF RIGHTS

Section 1. [Inherent and inalienable rights.] All men have the inherent and inalienable right to enjoy and defend their lives and liberties; to acquire, possess and protect property; to worship according to the dictates of their consciences; to assemble peaceably, protest against wrongs, and petition for redress of grievances; to communicate freely their thoughts and opinions, being responsible for the abuse of that right.

Sec. 2. [All political power inherent in the people.] All political power is inherent in the people; and all free governments are founded on their authority for their equal protection and benefit, and they have the right to alter or reform their government as the public welfare may require.

Sec. 7. [Due process of law.] No person shall be deprived of life, liberty or property, without due process of law.

Sec. 14. [Unreasonable searches forbidden. Issuance of warrant.] The right of the people to be secure in their persons, houses, papers and effects against unreasonable searches and seizures shall not be violated; and no warrant shall issue but upon probable cause supported by oath or affirmation, particularly describing the place to be searched, and the person or thing to be seized.

Sec. 22. [Private property for public use.] Private property shall not be taken or damaged for public use without just compensation.
